"No Refusal" DUI Enforcement Efforts Over Labor Day

Increased DUI enforcement efforts in Tennessee took place over this past Labor Day weekend. The Governor's Highway Safety Office (GHSO) and the Tennessee Highway Patrol worked together to coordinate the campaign in conjunction with state and local law enforcement.

As discussed in prior blogs, the "No Refusal" law was enacted earlier this year. The law permits law enforcement officials to seek a search warrant for a blood sample of a suspected drunk driver if the driver refuses to take a blood alcohol content (BAC) test. Before the law drivers could refuse such a test, but still faced a violation of the implied consent law.

The enforcement period ran between Friday evening and Monday morning. A total of 16 Tennessee counties were part of the campaign. These included: McMinn and Meigs (Chattanooga District); Roane and Campbell (Knoxville District); and Rutherford and Robertson (Nashville District). Rutherford County had the most DUI arrests with 21.

Only one suspect refused to take a BAC test. In that instance, law enforcement obtained a search warrant to force the suspect to give a blood sample.

If you are pulled over on suspicion of drunk driving it is important to note that even under the new law you still have rights. An officer must have reasonable suspicion to stop a vehicle. Additionally, before a judge will issue a warrant law enforcement has to prove probable cause.
